These Terms and Conditions ("Terms") govern your use of the WXCHANGE website located at wxchange.com.au ("Website") and your dealings with WXCHANGE ("we", "us", "our"). By accessing or using our Website, you agree to be bound by these Terms. If you do not agree, please do not use our Website.

 

WXCHANGE operates as a premium wellness equipment exchange business providing device sales, equipment brokerage, lead generation, and referral services to wellness industry operators across Australia and New Zealand.

1. Definitions

  • "WXCHANGE" refers to the business operating the wellness equipment exchange platform at wxchange.com.au

  • "Website" means the website located at wxchange.com.au and any related pages

  • "User" means any person who accesses or uses the Website

  • "Client" means a User who engages WXCHANGE for the purpose of purchasing, leasing, or financing wellness

  • "Services" means the equipment exchange, brokerage, marketing, and consulting services offered by

  • "Equipment" means any wellness device, product, or equipment listed, sold, leased, or arranged through WXCHANGE

 

2. Use of the Website

You may use the Website for lawful purposes only. You agree not to:

  • Use the Website in any way that violates applicable Australian or New Zealand laws or regulations

  • Transmit any unsolicited or unauthorized advertising or promotional material

  • Attempt to gain unauthorized access to any part of the Website or its related systems

  • Use the Website to harm, harass, or deceive any other person

  • Reproduce, copy, or redistribute any content from the Website without our prior written consent

3. Enquiries and Consultations

Submitting an enquiry form or booking a consultation through the Website does not constitute a binding agreement to purchase, lease, or finance any equipment. All enquiries are subject to:

  • Availability of equipment at the time of enquiry

  • Finance or lease approval by our third party finance partners where applicable

  • Execution of a formal purchase, lease, or finance agreement

WXCHANGE reserves the right to decline any enquiry or consultation request at its sole discretion.

 

4. Equipment and Pricing

All equipment pricing displayed on the Website is indicative only and subject to change without notice. Prices are quoted in Australian dollars (AUD) and exclude GST unless otherwise stated. Final pricing will be confirmed in a formal proposal or agreement.

 

WXCHANGE sources equipment from a range of suppliers and manufacturers. While we take reasonable steps to ensure accuracy, we do not warrant that equipment descriptions, specifications, or imagery on the Website are error free or complete.

 

Certified pre-owned equipment has been assessed and verified by WXCHANGE prior to listing. All pre-owned equipment is sold as described in the relevant product listing or proposal.

 

5. Finance and Lease Services

WXCHANGE may facilitate introductions to third party finance and lease providers on behalf of Clients. WXCHANGE is not a credit provider and does not itself provide finance or lease products. Finance and lease arrangements are subject to:

  • The terms and conditions of the relevant finance or lease provider

  • Credit assessment and approval by the finance or lease provider

  • Execution of a separate finance or lease agreement between the Client and the finance provider

 

WXCHANGE does not guarantee finance or lease approval and is not liable for any loss or damage arising from a declined application.

6. Service Guarantee

The WXCHANGE service guarantee applies to eligible devices as specified in the relevant purchase or lease agreement. The service guarantee is subject to:

​

  • The terms and conditions of the individual service agreement

  • Fair use of the equipment in accordance with manufacturer guidelines

  • The Client maintaining their service agreement payments where applicable

 

The 48 hour replacement guarantee applies to local cryo devices only as specified in the relevant agreement.

All other devices are subject to priority servicing terms as outlined in the service agreement. WXCHANGE reserves the right to modify or discontinue the service guarantee program with reasonable notice.

 

7. Intellectual Property

All content on the Website including text, images, graphics, logos, and software is owned by or licensed to WXCHANGE and is protected by Australian intellectual property laws. You may not reproduce, distribute, or create derivative works from any Website content without our prior written consent.

The WXCHANGE name and logo are trademarks of WXCHANGE. Nothing in these Terms grants you any right to use our trademarks.

8. Limitation of Liability

To the maximum extent permitted by Australian law, WXCHANGE excludes all liability for any direct, indirect, incidental, special, or consequential loss or damage arising from:

  • Your use of or inability to use the Website

  • Any errors, omissions, or inaccuracies in Website content

  • Any equipment purchased, leased, or financed through WXCHANGE

  • Any third party products or services referred to or accessible through the Website

Where liability cannot be excluded by law, our liability is limited to the resupply of the relevant service or the cost of having the service resupplied, at our election.

 

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded or limited.

 

9. Refunds and Returns

Refund and return policies for equipment purchased through WXCHANGE are as follows:

Change of Mind

WXCHANGE does not offer refunds or exchanges for change of mind on equipment purchases once a formal purchase agreement has been executed and the equipment has been delivered.

 

Finance and Lease Agreements

Refund and cancellation rights for finance and lease arrangements are governed by the terms of the relevant finance or lease agreement. Clients are encouraged to review those terms carefully before signing.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Amendments

WXCHANGE reserves the right to amend these Terms at any time. Updated Terms will be posted on the Website with a revised effective date. Your continued use of the Website after any amendment constitutes your acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from the Terms and the remaining provisions will continue in full force and effect.
